In opposing Stephen Douglas’s alleged popular right to choose a slave constitution, Abraham Lincoln developed a rudimentary conception of the normative presuppositions of democratic rights that prefigures the theory of popular sovereignty articulated by Jürgen Habermas. While Lincoln was influenced by a civic republican conception of natural rights, and referred to personal autonomy in arguing that some political choices violate the grounds of collective self-governance rights, both Lincoln—as read by Jaffa—and Habermas conceive human rights not as trans-political principles but (...) as linking moral norms with the rule of law (or coordination through political power in general). The comparison shows that Habermas’s approach to the co-originality of civil liberties and democratic rights implies that legitimate secession, revolution, and primary constituent authority must be oriented toward creation of a just legal order. This enriched linkage approach explains why the right to democracy, like the right to basic liberty, is inalienable. (shrink)

With Wind Wizard, Siobhan Roberts brings us the story of Alan Davenport, the father of modern wind engineering, who investigated how wind navigates the obstacle course of the earth's natural and built environments--and how, when not properly heeded, wind causes buildings and bridges to teeter unduly, sway with abandon, and even collapse. In 1964, Davenport received a confidential telephone call from two engineers requesting tests on a pair of towers that promised to be the tallest in the world. (...) His resulting wind studies on New York's World Trade Center advanced the art and science of wind engineering with one pioneering innovation after another. Establishing the first dedicated "boundary layer" wind tunnel laboratory for civil engineering structures, Davenport enabled the study of the atmospheric region from the earth's surface to three thousand feet, where the air churns with turbulent eddies, the average wind speed increasing with height. Over the years, Davenport's revolutionary lab investigated and improved the wind-worthiness of the world's greatest structures, including the Sears Tower, the John Hancock Tower, Shanghai's World Financial Center, the CN Tower, the iconic Golden Gate Bridge, the Bronx-Whitestone Bridge, the Sunshine Skyway, and the proposed crossing for the Strait of Messina, linking Sicily with mainland Italy. Chronicling Davenport's innovations by analyzing select projects, this popular-science book gives an illuminating behind-the-scenes view into the practice of wind engineering, and insight into Davenport's steadfast belief that there is neither a structure too tall nor too long, as long as it is supported by sound wind science. The work of Carl von Clausewitz Clausewitz, Carl von, [1832] 1976. On War, Michael Howard, and Peter Paret, eds. and trans. Princeton, NJ: Princeton University Press. [Google Scholar] continues to provoke heated debate. For some scholars, Clausewitz's On War remains indispensable to serious thought on the resort to war in the modern period. Others, however, see Clausewitz's work as either outdated, or a morally repellent argument for unlimited, unrestrained and brutal warfare. This essay argues not only that Clausewitz's work (...) continues to be relevant to discussions on the use of armed force, but also that On War provides a framework for ethical reflection on war and its conduct. Two main preoccupations of western military academies and staff colleges—Clausewitz on the one hand, and the just war tradition on the other—can complement, rather than rival each other. On War creates a space for reflection on the use of armed force, and for that reason if no other, should still be considered an important resource for contemporary students and practitioners of strategy. This article examines the philosophical teaching of a colorful Oxford alumnus and Roman Catholic convert, Christopher Davenport, also known as Franciscus à Sancta Clara or Francis Coventry. At the peak of Puritan power during the English Interregnum and after five of his Franciscan confrères had perished for their missionary work, our author tried boldly to claim modern cosmology and atomism as the unrecognized fruits of medieval Scotism. His hope was to revive English pride in the golden age of medieval (...) Oxford and to defend English Franciscans as more legitimately patriotic and scientifically progressive than Puritan millenarians. (shrink)

Good people often die badly, and, sometimes, bad people die well. Both are true for complex reasons. We worry that the tropic formulation trades on a simplistic anthropology that belies the complexities of how persons operate in the world. In this essay, we are interested in these complexities and a better theological acknowledgement of them, not least because the fantasy of the good death ill prepares one for real death. We argue that valorizing pious religious death and profane ugly death (...) loses sight of these complexities, which we think should comprise any account Christians give about what persons are and are in their dying—an account that often goes by the name “theological anthropology.” It is the simplistic theological anthropology more than the tropic formulation—the anthropology the trope smuggles in—that concerns us. Our argument proceeds by first examining the fantasy of the good death, measuring it against a historical record with an examination of the Ars Moriendi tradition, and then thinking more broadly about what motivates it. Along the way, we consider a recent film, The Farewell, where good-death fantasies comically run up against death’s reality and where goodness, truth, and beauty show up anyhow. (shrink)

Background: This study examined the cyberbullying experience and coping manners of adolescents in urban Vietnam and explored the mediating effect of different support to the associations between cyberbullying and mental health issues.Methods: A cross-sectional study was performed on 484 students at four secondary schools. Cyberbullying experience, coping strategies, psychological problems, and family, peer, and teacher support were obtained. Structural equation modeling was utilized to determine the mediating effects of different support on associations between cyberbullying and psychological problems.Results: There were 11.6 (...) and 28.3% of students who reported that they experienced and observed at least one cyberbullying act in the last 3 months, respectively. Among the victims, only 48.2% tried to stop the perpetrators. Meanwhile, the majority of observers belonged to the “Intervene” group who tried to report cyberbullying acts or help victims. Family support was found to partially mediate associations between cyberbullying experience and observation with levels of psychological problems among adolescents.Conclusion: The 3-month rate of cyberbullying experience and observation among urban adolescents aged 11–14 was low. However, current coping strategies against cyberbullying were not sufficient. Family support is an important factor that should be considered for designing interventions to mitigating the impacts of cyberbullying on the mental health of adolescents. (shrink)

Davenport argues for a federation of democracies to replace the United Nations Security Council. This new level of government, he says, is necessary to achieve the international cooperation needed to manage a global economy and address global problems.

This article defends the Responsibility to Protect doctrine against critiques by Fabrice Weissman in this journal, and against similar criticisms of humanitarian intervention and human rights norms made by postmodern thinkers in the Nietzschean tradition, such as Alain Badiou and Anne Orford. I argue against Weissman that R2P can be effective in stopping or preventing mass atrocities, and in particular that opposition to military intervention in Syria during the 2013 debates was a terrible mistake. Moreover, the moral ground for humanitarian (...) aid efforts is the same as the basis for forceful rescue from mass slaughter, ethnic cleansing, and persecution. Weissman's critiques misinterpret just war theory on key points and rely on inflated rhetorical strategies inspired by extreme forms of cultural and moral relativism that are intellectually bankrupt—both in blaming “Western imperialism” for most crimes against humanity committed by tyrants, and in leaving hundreds of thousands without the only protection that could prevent their murder and exile. These extreme positions and the strained rhetorical devices used to defend them do not deserve the wide respect they command in some parts of academia. (shrink)

This essay argues that Mark C. Murphy's original contribution to natural law ethics succeeds in finding a way between older metaphysical and newer purely practical approaches in this genre. Murphy's reconstruction of the function argument, critique of subjectivist theories of well-being, and rigorous formulation of a flexible welfarist theory of value deserve careful attention. I defend Kant against Murphy's critique and argue that Murphy faces the problem of showing that all his basic goods are morally inviolable. Although I endorse Murphy's (...) critique of radical virtue ethics, I raise objections to the basic moral norms he derives from his list of goods, and to the analysis of peace of mind and happiness as basic goods. It is widely thought that stealing, trading and destroying cultural artifacts in time of war are inherently immoral actions, and that it is right that they be treated as war crimes, which, indeed, they currently are. But oppressive cultures have their heritage and cultural artifacts too, in the form of monuments, sites of worship, and so on; and for the oppressed, these things may be awful reminders of their subordination, and may even perpetuate it. This chapter suggests that, since cultural (...) objects can be both tools and symbols of unjust oppression, their theft and destruction ought to be seen as appropriate when this would be a means of overcoming oppression. Whatever current law may say, in these instances, it would be morally inappropriate to count such acts as war crimes. Furthermore, it is bizarre that theft and destruction of cultural property are counted as war crimes when soldiers killing each other is not (due to combatant immunity). Surely killing is worse than property destruction and theft. It is therefore argued that, where possible, it would be better for conflicts to be fought using the latter methods. Finally, the chapter responds to many objections to using theft and destruction of cultural property as a method of warfare. E.g. to the objection that such property has timeless, trans-cultural, aesthetic, historical and scientific value, it is replied that justice is a more important value; and to the objection that these practices amount to cultural genocide it is replied that unjust cultures have no right to exist unmodified. ABSTRACT As doctoral students from New Zealand and Australia, advised by supervision teams with a diversity of critical realist experience from limited to none, we came independently to the 2018 Critical Realism conference – primed to seek increased understanding, confidence, motivation, and reassurance. We certainly found these things from the pre-conference, presentations, and individuals within the critical realist community. We also found each other, and a virtual writing group was born. This article is a description of what we did, why, (...) and the outcomes we experienced over the final two years completing our theses. It identifies the structures, contexts, motivations, and mechanisms from which our emotional, critical realist and writing-related outcomes emerged. We outline the roles of serendipitous timing, culture, different disciplinary approaches, administrative structures, and types of interactions on the social learning we developed. We anchor our discussion in recent theoretical literature about the role of writing groups in doctoral education. (shrink)

In this article we examined the ways in which strategic ambiguity in the use of keywords served an enabling function within a discourse marked by conflict and ideological divisions. Our analysis focused on the intertextual relationships between five documents intended by the government to guide the development of biotechnology in New Zealand. Through our analysis we identified ‘sustainability’ as a keyword and three major roles for the deployment of the discourse strategy of strategic ambiguity in the use of this keyword. (...) First, strategic ambiguity lent an internal and intertextual coherence to the texts. Second, it allowed multiple perspectives and objectives to co-exist. Third, strategic ambiguity facilitated the participation of discourse actors who subscribed to ideologies that were more or less incommensurable. (shrink)

In the last two decades, interest in narrative conceptions of identity has grown exponentially, though there is little agreement about what a "life-narrative" might be. In connecting Kierkegaard with virtue ethics, several scholars have recently argued that narrative models of selves and MacIntyre's concept of the unity of a life help make sense of Kierkegaard's existential stages and, in particular, explain the transition from "aesthetic" to "ethical" modes of life. But others have recently raised difficult questions both for these readings (...) of Kierkegaard and for narrative accounts of identity that draw on the work of MacIntyre in general. While some of these objections concern a strong kind of unity or "wholeheartedness" among an agent's long-term goals or cares, the fundamental objection raised by critics is that personal identity cannot _be_ a narrative, since stories are artifacts made by persons. In this book, Davenport defends the narrative approach to practical identity and autonomy in general, and to Kierkegaard's stages in particular. (shrink)

For the past 5 years I have been photographing and interviewing men who play games based on contemporary conflicts. The games attempt to re-create scenarios that the US military is engaged in around the world like the "Hunt for Osama Bin Laden" that took place three years ago on a campground in Northern, Virginia. On a sociological level, the work speaks about the way that trauma and conflict penetrate a culture sheltered from the horrors of war. Many of the scenarios (...) are created and inspired from news reports and images and the stages where the games are played are often a poor imitation of the original scenes from photographs. The book will bring together the series of 24 photographs with essays discussing and analyzing the influence of the media, particularly photographs and video, on the culture at large and how conflict is "discussed" in the visual realm. One of the fundamental and seemingly simple aims of mathematical knowledge management (MKM) is to develop and standardize formats that allow to “represent the meaning of the objects of mathematics”. The open formats OpenMath and MathML address this, but differ subtly in syntax, rigor, and structural viewpoints (notably over calculus). To avoid fragmentation and smooth out interoperability obstacles, effort is under way to align them into a joint format OpenMath/MathML 3. We illustrate the issues that come up in such an (...) alignment by looking at three main areas: bound variables and conditions, calculus (which relates to the previous) and “lifted” n-ary operators. This paper begins by tracing the Hobbesian roots of `representationalism:' the thesis that reality is accessible to mind only through representations, images, signs or appearances that indicate a reality lying `behind' them (e.g. as unperceived causes of perceptions). This is linked to two kinds of absolute realism: the `naive' scientific realism of British empiricism, which provoked Berkeley's idealist reaction, and the noumenal realism of Kant. I argue that Husserl defined his position against both Berkeleyian idealism and these forms of absolute (...) realism by way of two arguments: a pragmatic argument against skepticism about the external world (as described by Karl Ameriks) and a distinctively phenomenological argument against the representationalism implied by absolute realism. In his contribution to a recent symposium on Habermas's work, (1) Charles Larmore critiques Habermas's Between Facts and Norms (2) from a largely Rawlsian perspective. His reading raises fundamental questions that divide Habermas from American pragmatists and other contextualists, and helps reveal, in my view, that the differences between Habermas's and Rawls's conceptions of justice are more basic than is often recognized. Yet as I will argue, in several places Larmore misconstrues Habermas's position and fails to understand his point at (...) crucial junctures, largely because he attempts to discuss.. (shrink)

UPtSn is known as a semimetal with a bandgap in the electronic density of states. We report the results of measurements of the cubic lattice parameter a , coefficient of thermal expansion f , magnetic susceptibility h , magnetization † , specific heat C and electrical resistivity „ . We give arguments that this compound is antiferromagnetically ordered with T N = 35 K, although this is not confirmed by neutron diffraction. For carefully annealed samples of UPtSn we provide a (...) phenomenological description of electron transport properties in terms of the fact that the temperature-dependent bandgap is closed at T = 0 K. Results of electrical measurements on the isostructural compounds ThPtSn and ZrPtSn provide evidence for bandgap formation in these two compounds as well. (shrink)

I have argued that like Harry Frankfurt, Augustine implicitly distinguishes between first-order desires and higher-order volitions; yet unlike Frankfurt, Augustineheld that the liberty to form different possible volitional identifications is essential to responsibility for our character. Like Frankfurt, Augustine recognizes that we can sometimes be responsible for the desires on which we act without being able to do or desire otherwise; but for Augustine, this is true only because such responsibility for inevitable desires and actions traces (at least in part) (...) to responsibility for our volitional identifications, which in turn has leeway-libertarianconditions. However, David Hunt has interpreted Augustine’s account of divine foreknowledge as implying a type of source-incompatibilism that does not require alternative possible actions or intentions. Moreover, while Eleonore Stump’s account of Augustine on sanctification supports my interpretation, Augustine’s position on predestination in his latest writings may be incompatible with liberty of the higher-order will. I will argue against Hunt’s interpretation but admit that the leeway-libertarian has to reject the ‘no autonomy’ model in some of Augustine’s late writings. (shrink)

According to Father Patrick Verspieren, a Roman Catholic priest and member of the Society of Jesus, the chief duty of the palliative care-giver is to suspend all preconceptions of the incurably ill patient's journey to life's end: "To accompany a dying patient is not to walk ahead of him, or to show him the right path, or to impose an itinerary on him, or even to presume to know what direction he will take. Rather, it consists in walking at the (...) patient's side, leaving him free to choose his own way and the rhythm of his own step".
